F.B.I. agents in every region of the country have mishandled, mislabeled and lost evidence, according to a highly critical internal investigation that discovered errors with nearly half the pieces of evidence it reviewed.
The evidence collection and retention system is the backbone of the F.B.I.’s investigative process, and the report said it is beset by problems. It also found that the F.B.I. was storing more weapons, less money and valuables, and two tons more drugs than its records had indicated.
The report’s findings, based on a review of more than 41,000 pieces of evidence in F.B.I. offices around the country, could have consequences for criminal investigations and prosecutions. Lawyers can use even minor record-keeping discrepancies to get evidence thrown out of court, and the F.B.I. was alerting prosecutors around the country on Friday that they may need to disclose the errors to defendants.
Many of the problems cited in the report appear to be hiccups in the F.B.I.’s transition to a computer system known as Sentinel, which went online in 2012 and was intended to move the bureau away from a case-management system based on paper files. But other problems, including materials that disappeared or were taken from F.B.I. evidence rooms and not returned, are more serious.
“A majority of the errors identified were due in large part to human error, attributable to a lack of training and program management oversight,” auditors wrote in the report, which was obtained by The New York Times.
F.B.I. officials on Friday said that they decided on their own to conduct the review after discovering during an internal audit that there might be issues with the record keeping for evidence.
“The FBI identified issues primarily related to the migration of its earlier record-keeping process to its updated case management system,” said Michael Kortan, the F.B.I.’s chief spokesman. “The bureau is now strengthening procedures in field offices across the country to improve administrative consistency and record-keeping.”
The F.B.I. is separately dealing with the fallout from a case at its Washington office, where an agent is under investigation for tampering with evidence. That has led to the dismissal of convictions in some drug cases. Though the internal review is unrelated to that matter, the issues are so entwined that the F.B.I. plans to distribute the report to dozens of lawyers involved whose cases were affected by the Washington investigation, officials said.
The errors cited in the audit range in severity from computer glitches and duplicate bar codes to evidence that could not be located. The investigation found that federal agents had removed 1,600 pieces of evidence from storage and had not returned them for more than four months. One piece of evidence in a drug case has been signed out since 2003. Another piece of evidence has been out since 2006, the report found.
Because the audit was based on a sample, the actual number of items that have been checked out and not returned is probably much higher.
The results also varied by field office. In Newark, Honolulu, Milwaukee, Washington and Richmond, Va., for instance, auditors found problems with the handling of more than 70 percent of firearms in evidence. By comparison, offices in El Paso, New Haven and Sacramento turned up error rates in the single digits.
When Sentinel went online, the bureau said it would streamline investigations and make it easier for analysts and agents to “link cases with similar information through expanded search capabilities.” It was also supposed to make information more quickly available to investigators in different field offices.
A report released in September by the Department of Justice inspector general found Sentinel had, over all, reduced the number of lost documents and made it easier to share information. That inquiry, however, cited problems with Sentinel’s search function.

Australian mother arrested for murdering her 7 children and a niece

An Australian mother has been arrested for murder in the mass killing of eight children who were found dead in the city of Cairns, seven of whom were hers. The eighth child was her niece.
The woman’s name has yet to be released by law enforcement, but police said the 37-year-old has been arrested for murder. However, she has not been charged, and the Queensland Police Service noted she is “assisting” authorities with their investigation.
Detective Inspector Bruno Asnicar said the mother is now awake and conscious after suffering from stab wounds and being hospitalized.
According to the Associated Press, authorities have not said exactly how the children, who were found dead in the woman’s home, were killed. They did say they are inspecting multiple knives from the house as potential weapons.
Meanwhile, Reuters described the murders as “a mass stabbing.” The children ranged in age, from 18 months to 15 years old.
“We’re not looking for anybody else, we’re comfortable that the community at large is safe,” Asnicar said to the AP.
While the woman is currently talking to police, a coroner is conducting autopsies on the children to establish their cause of death.
The arrest comes the day after the children were found dead in the mother’s home. Local resident Lisa Thaidai said that another sibling, a 20-year-old, was actually the one to discover the situation.
“We’re a big family … I just can’t believe it. We just found out [about] those poor babies,” Thaiday said, as quoted by AFP.
Cairns Post reporter Scott Forbes stressed that the area is very close, in fact, he said the people on that street are related.
“All of the people here are actually related to the people who were involved in this incident,” he told the Australian Broadcasting Corporation. “So they’re all reeling at the moment. But telling us that she was a very, very protective, very proud mother who loved her children dearly,” he added.
Australian Prime Minister Tony Abbott described the news as “heartbreaking.”
“All parents would feel a gut-wrenching sadness at what has happened. This is an unspeakable crime. These are trying days for our country,” Abbott stated.
The tragedy comes as Australia is still in shock following a deadly siege in a Sydney cafe on Monday. It resulted in two hostages being killed along with the gunman after police stormed the cafe some 16 hours into the stand-off.

N. Korea Proposes Joint Probe Over Sony Hacking

(SEOUL, South Korea) — North Korea on Saturday proposed a joint investigation with the U.S. into the hacking attack against Sony Pictures Entertainment, warning of “serious” consequences if Washington rejects a probe that it believes would prove Pyongyang had nothing to do with the cyberattack.
The proposal was seen by analysts as a typical ploy by the North to try to show that it is sincere, even though it knows the U.S. would never accept its offer for a joint investigation.
U.S. officials blame North Korea for the hacking, citing the tools used in the Sony attack and previous hacks linked to the North, and have vowed to respond. The break-in resulted in the disclosure of tens of thousands of confidential Sony emails and business files, and escalated to threats of terror attacks against U.S. movie theaters that caused Sony to cancel the Christmas Day release of “The Interview,” a comedy about a plot to assassinate North Korean leader Kim Jong Un.
On Saturday, an unidentified North Korean Foreign Ministry spokesman in Pyongyang proposed the joint investigation with the U.S., saying the North knows how to prove it’s not responsible for the hacking. He also said Washington was slandering Pyongyang by spreading unfounded rumors.
“The U.S. should bear in mind that it will face serious consequences in case it rejects our proposal for joint investigation and presses for what it called countermeasures while finding fault with” North Korea, the spokesman said in a statement carried by Pyongyang’s official Korean Central News Agency, or KCNA.
“We have a way to prove that we have nothing to do with the case without resorting to torture, as the CIA does,” he said, adding that the U.S. lacks any specific evidence tying North Korea to the hacking.
Koh Yu-hwan, a professor at Seoul’s Dongguk University, called the North’s proposal a “typical” tactic the country has taken in similar disputes with rival countries. In 2010, North Korea proposed a joint investigation after a South Korean-led international team concluded that the North was behind a torpedo attack that killed 46 South Korean sailors, though Pyongyang denied its involvement. South Korea rejected the North’s offer for the joint probe.
“They are now talking about a joint investigation because they think there is no conclusive evidence,” Koh said. “But the U.S. won’t accede to a joint investigation for the crime.”
On Friday, President Barack Obama declared that Sony “made a mistake” in shelving the satirical film about a plot to assassinate the North Korean leader, and pledged that the U.S. would respond “in a place and manner and time that we choose” to the hacking attack on Sony that led to the movie’s withdrawal.
“I wish they had spoken to me first. … We cannot have a society in which some dictator someplace can start imposing censorship,” Obama said at a year-end news conference, speaking of executives at Sony Pictures Entertainment.
Sony said it had had no choice but to cancel distribution of the movie because theaters were refusing to show it.
U.S. options for acting against North Korea are limited. The U.S. already has severe trade sanctions in place, and there is no appetite for military action. Even if investigators could identify and prosecute the individual hackers believed responsible, there’s no guarantee that any located are overseas would ever see a U.S. courtroom. Hacking back at North Korean targets by U.S. government experts could encourage further attacks against American targets.
North Korea and the U.S. remain in a technical state of war because the 1950-53 Korean War ended with an armistice, not a peace treaty. The rivals also are locked in an international standoff over the North’s nuclear and missile programs and its alleged human rights abuses.
Earlier Saturday, North Korea angrily denounced a move by the United Nations to bring its human rights record before the Security Council and renewed its threat to further bolster its nuclear deterrent against what it called a hostile policy by the U.S. to topple its ruling regime.
Pyongyang “vehemently and categorically rejects” the resolution passed by the U.N. General Assembly that could open the door for its leaders, including Kim Jong Un, to be hauled before the International Criminal Court for crimes against humanity, according to a Foreign Ministry statement carried by KCNA.
The Security Council is due to meet Monday to discuss Pyongyang’s human rights situation for the first time.
The meeting caps almost a year of international pressure, and even though ally China could use its veto power to block any action against the North, the nonbinding resolution has broad support in the General Assembly and has drawn unusually strong and vitriolic protests from Pyongyang.

Researches find security flaws in a system used by cellphone carriers that allows spying on mobile phone traffic.
Researchers have found a security hole in a system used by global cellphone carriers that can open the door for hackers to eavesdrop on private phone calls, text messages and data traffic on a large scale.
The security flaws discovered by the Berlin-based Security Research Labs could affect a telecommunications standard known as Signaling System 7, or SS7, which is used by cell phone carriers to manage connections between cellular networks.
The flaws include functions that are built into SS7 such as keeping calls connected as users speed down highways as well as switching between cell towers.
The German researchers said a skilled person could use the shortcomings for surveillance of mobile phone traffic.
“Given how valuable such spying capabilities are to states and other criminal actors, I would be very surprised if we are first to find these hacking vectors,” company researcher Karsten Nohl said Friday.
Nohl further said cellphone companies were quietly informed of the problematic issue earlier this month.
Two German mobile firms, T-Mobile and Vodafone Deutschland, have said they have adopted measures to prevent hackers and spies from exploiting the deficiency.
Nohl also said cell phone carriers could easily fix the issue by blocking certain network requests submitted over SS7 by other companies, adding, “We were really surprised that most of them don’t do that.”
The details of the problem are slated to be presented at a computer security conference in Hamburg, Germany, next week.

The United Nations estimates 1,523 Palestinian civilians, including 519 children, and six Israel civilians were killed in the Gaza conflict.The two sides agreed to a cease-fire in August. In a separate incident on Friday, four Palestinian protesters were shot in the legs by Israeli troops after they ignored warnings to keep away from the border fence between the coastal territory and the Jewish state, the military and Gaza medical officials said.
